ASHBURTON—THURSDAY.

Alleged Assault.—A charge of having assaulted his wife, laid against John Murphy, was held over for a week. Civil Cases.—A. M. Pearson v A. Gadd, 10.* -paid in advance for photographs that defendant failed to supply. H. Zander y J. Osborne, w7l 10s 3d— amount of dishonored bill —Judgment in each case by default. J. R. Steel vJ. Dwyer, £7 lls 6d~amounfc of a dishonored promissory note. Mr Crisp for plaintiff. The amount of the bill had been paid into court, but not the court i costs. After a somewhat lengthy hearing judgment was given for plaintiff, with coots. Newnun v P. J. Cullen, £13 17s 61. Mr Wilding for plaintiff; Mr Purnell for defendant. This was a claim for loss and damage sustained and expanses incurred by plaintiff, the result of defendant's un- j skilrulness while in charge of a horse »nd buggy hired by him from plaintiff. The j evidence of plaintiff was to the effect that defendant having hired a horse and buggy from defendant's livery stable to go to Longbeach, while there took the blinkers off the mare, tc feed her, without taking her out of harness. She plunged about, smashed the trap and harness, cut herself about the leg?, and generally damaged herself. Plaintiff had been put to ex pense in repairing the trap, in getting mare and trap home, and had loot business in consequence of the trap having to go under repairs and the mare being useless now as a mare for hire. Evidence as to damage etc., was given at length, and finally the Bench found that defendant, though perhaps accustomed to drive horses, was not accustomed to them in any other capacity. His inexperience in letting the blinkers over the horse's face had caused the accident, and judgment. was given for £8 6s 6d, with costs.
