Action tor Damages.—Thomas Slator v. the Auckland City Council.—This was a claim that a certain deed of lease should be cancelled, and £700 allowed as damages. Mr J. A. Tole appeared for plaintiff, instructed by Mr Johnston, and Mr Tbeo. Cooper for defendants, instructed by Mr T. Cotter.—The claim was to be relieved of the lease of the City Market, which witness held for three years. The grounds for asking the release were that the Council had not fulfilled the conditions upon which the lease had been taken with regard to tolls, fetalls, stallages, etc. ; also that the Council had let the land on which the Market stands, whereas according to the Act the Corperation were only empowered to let the right to collect the rents from the Market House itself.—Thomas Slator deposed to seeing the Town Clerk with regard to leasing the Market.—Mr Philips said that the Market was worth £120 per month. —Witness knew as well as Mr Philips what it was worth, and therefore said it wa3 worth £ICO per month to anyone with the tolls and dues. —Mr Philips said the tolls and dues would be 'enforced. The Market was not worth more than £40 per month without the tolls and dues. Mr Philips gave him to understand that a short Bill was to be passed through the > House in order to compel all the produce to go through the Market. He added that the farmers had used the streets of Auckland long enough for nothing. i (Left Sitting.)
