AUCKLAND, Tliis day'. A sequel to an acciclent in a wliarf shed in Novembcr, 1927, wlien Arthur Yates, a tally clerk, was injured through a bale of paper -striking him after it had landed from a chute, was lieard in the Supreme Court before Mr JuKtice Herdman, when the Union Steam Ship Company elaimed £396 18s from James Clievis, carrier, as iudemnity for compensation paid to Yates, who was employed by the plaintiff' company. It was stated for plaintiff tliat the bale with which Yates was struck was sent down tlie chute by Clievis. rt weighed about 5cwt and 011 landitig from the upper floor of the shed lcnockcd \7ates over. Negligence hy dcfendaut was allcged in that the buffer usually placed on the chute to prevent articles bount^ing after landing had not heen used. After Jegal argumcnt judgment was given for the defendant with costs.
