TNJURED MAN CLA1MS £1500 DAMAGES. CASE IN WELLINGTON COURT.
WELLINGTON, This day. A watersider, Mr Joseph O'Brien, is pursuing a claim in the Supreme Court, before His Honour, Mr Justice Rinith against the Dimedin-Wanganui Shipping Co.. arising from.an accident on the Holmdale, plaintiff alleging pcrmanent injury in regard to whicli medical evide'nce was given, assessing the injury at two-thirds of plaintiff' s earning capacity. Plaintiff was struck by some cargo falling out of a sling and negligence is alleged 011 the part of the defendant 111 allowing cargo to he loaded on the principle. of block stowing, and in failing to provide fore and aft space of at least eleven feet between the fore and aft cnds of the hateh coaniings and tlie nearest cross bcam. It is also contended that the omission of the liateliman to stop the hoist until the sling had ceased spinning,' contributed to the accident. The claim is for £1500. The defence is that the hreaking of the sling was pure accident and defendant himself was negligent in failing to step clear after making np tho sling, also in preparing the sling and in other ways.
