W. Webb v. lan Sim son,—Claim £6 Is, for work clone. Mr R. N. Jones appeared for the plaintiff, and Mr DeLautour for the defendant. The plaintiff, who is a bricklayer carrying on business in Gisborne, gave evidence that the work done for the defendant was charged at a reasonable rate, and he had received no complaints with regard to it.—John Webb, son of the plaintiff, deposed that he had charge of the work referred to, and the price was reasonable. Mr Shnson pointed out the work, and showed him several places round the foundation where the bricks were fretted away.—Mr DeLautour stated that the defence was that the work was not done sufficiently well to pass any man skilled in that sort of thing. The defendant had left himself entirely in the hands of the plaintiff, but wanted the bricks pointed, they having fretted and the mortar was coming away, The plaintiff suggested that it would be better to cement the wall. The job was to be done in a workmanlike manner, and as oheaply as possible. The work was not done well, as the plaster came away freely. Mr Simson was willing to pay for the work if it had been done properly.—ln cross-exami-nation, the defendant said that there was no price mentioned, but he thought the cost would be about ,£3. —Mr Quigley, architect, gave expert evidence. —His Worship considered that the work was of some value, and gave judgment for the plaintiff for and costs.
