No Protection for Native Game.

Dunedin, last night. An important decision was given by Mr Cruickshank, S.M., at Kaitangata, in a case in which a man was charged with killing native game out of season. Mr I inch, for defendant, submitted that at present it was no offence to kill native game in New Zealand. '' In support of this contention, he pointed out that in common law it was not an offence to kill native game, and that section 17 of the Animals Protection Act, 1880, whic-h made it an offence to do so, had been repealed by section 5 of the amending Act of 1900 and had not been re-enacted as it ou»ht to have been. The Magistrate upheld the latter contention, and dismissed the information. This means that thereMs no protection for ducks, etc., at present,
