INVERCARGILL COURT.

Per Press Association * Invercargill, last night. At the Supreme Court Carl Hertz was acquitted of an attempt to commit an unnatural offence, also of indecontly assaulting a boy in a country hotel. The verdict was received with applause. The peculiar point raised regarding the jury’s finding of a true bill against Dr Fullerton by a smaller majority than the law allows troubled the bench and bar, there being no precedents nor authorities on the matter. Finally the Judge said that the trial would go on. In the evont of a conviction the question could be reserved for the Appeal Court. Counsel for accused were in favor of this course rather than hanging the matter up for a few months. Judge Williams said that the matter was most important, and the decision of the highest court was desirable. This could not be got if he gave a ruling then and there.

A charge against Eosannah McCoy of alleged stealing £2l from a house she visited was not finished when the Court rose.
