BRUCE POLL DECLARED VOID.

Dunedin, last night. Mr Cruickshanks declared tho Bruce licensing poll void, mainly on the ground that proper polling hours were not observed at 'Manuka Creek, Berwick, and Waitahuna Gully, which were distinct breaches of the second sub-section of tbe Common Law of Elections. In ordinary instances premature closing would not void the election unless the results were shown to be affected, but in this case they were acting under a more stricter law.

He next dealt with the cases of irregularities tending to defeat the fairness of the election. In the majority of cases relied on he did not think individual acts defeated the fairness of the election, but in the Milburn case there was a distinct breach of the secrecy of the ballot. His Worship declared the election void because the poll was closed improperly at Manuka Creek, Berwick, and Waitahuna Gully, also because the tendency of the practice was violating the secrecy of the ballot and so defeating the fairness of the election.
