ATTEMPT TO EVADE ALIEN AOT By, telegraph, Press Ass’n, Copyright Reoeived 11.12 p.m., Maroh 5. Sydney, Maroh 5. The oase of Malouf, charged with not having left Australia at the expiry of his certificate of exemption as a prohibited immigrant, came before Justice Court. Evidence was given by Customs officials of the issue and subsequent renewals of the cerlificate of exemption, which was signed by the acting Collector of Customs. Oouhs9l for the defence submitted that as no test was applied to Malouf he never was a prohibited immigrant, so that the cerlificate of exemption should not have been given him. It was no better than waste paper, because it was not signed by a Minister of the Crown, or a duly authori ed officer. The Magistrate adjourned tbe case until Friday to enable him to examine the points raised.
