(Press Association.) AUCKLAND, May 12. James W. Waller was charged at the Police Court with a breach of the Bankruptcy Act in contracting liabilities without having reasonable or probable grounds of being able to pay, and with having, while an undischarged bankrupt, incurred liabilities with Archibald Bryden, obtaining credit by myans of fraud. Bankrupt’s solicitor said bis client would plead guilty. He asked that ho be dealt with summarily, urging bis great ago and the exceptional circumstances. AValler might not have had reasonable grounds- to believe ho could discharge his liabilities, yet lie thought the equity of property in Australia would help, and he anticipated- help from a brother who had property worth £26,000 to £27,000. It appeared that accused had pleaded, guilty to -four out of eleven charges, and the others bad been dropped. Mr Kettle, S.iM., said it was for him to determine whether the charges could l bo withdrawn once they were laid. 'lt was not for the police, counsel, or others to arrange. Accused’s counsel, under the altered circumstances, withdrew the plea of guilty, and the ca6e stands adjourned to May 27.
