Charles Ellis Davis charged with a similar offence, on the Kamo occasion, pleaded "not guilty.” Walter Earnest Chittenden, railway guard, stated that he was on dutv on tho train from Gisborne to I’ll ha cm the night in question. A disturbance “ took . place between the defendant- and Turnbull, when the train was between- Makauri and “Wailiirere. Witness, separated tho men, but- subsequently saw them again quarrelling. On this occasion defendant had his overcoat off, and. Tymbull liad divested himself of Ins coat and vest. He again separated the pair and ultimately put Turnbull into another carriage. Evidence was also given by Constable Dovle and George Turnbull. His Worship said that fiucli conduct- as had evidently taken place on the train was very disgraceful. It would certainly never do to permit such a state of affairs to exist. He could not help' thinking that - both defendants had been undey. the influence of liquor. Defendant would be fined £1 with costs 11s, iii default 4 days’ imprisonment. MAINTENANCE OASES.

Adl'.lia Ilastie proceeded against -her husband, Robert Ilastie, oil a charge of having failed to provide for her maintenance. Defendant did not put- in an appearance, anil after hearing the evidence of the complainant, His Worship made an order for the payment of 15s per week. The case of Anna Louisa Streeter v. Frank Streeter was also mentioned. Defendant was charged with having failed to comply with the terms of ail order requiring him to provide, for his wife and child. In extenuation he pleaded lack of employment and the ease was adjourned for a fortnight. A young man named William Murray, wljo was arrested on a warrant dated Auckland, October sth, 1907, was charged with, that he, “being the putative father of an unborn illegitimate child, was about to leave the Dominion without having made provision for the maintenance of 6uch child. Mr. T. Alston Coleman appeared for accused, and tho case was remanded until this morning, to enable certain enquiries to be made in Auckland.
