TUESDAY, FEBRUARY 2. (Before Mr. W. A. Barton, iS.M.) CYCLING ON THE FOOTPATH. For cycling on the footpath within the borough, Ge.o. M. Humphries was fined 10s and 7s costs. BREACH OF PROHIBITION ORDER .Tolm William Collins was charged wftli being on licensed premises during the currency of a prohibition order against lvim. Mr. J. It. Kirk appeared for accused, who pleaded guilty. iSe.rg-t. Hutton explained that. Constable Dandy bad found the accused in the British Empire Hotel with a glass of lemon squash in his hand. .
His Worship said that it was no excuse that accused was not drinking intoxicating liquor. He had no right to be on licensed premises at all. Accused would be fined £2, with 7s costs, or seven days’ imprisonment.
“THE SHIPPING AND SEAMEN’S ACT. The Collector of Customs (Mr. J. Howie) proceeded against Captain J. H. Hawkes, of the s.s. Tua.tea, for failing to deliver up to the .Superintendent of Marine his agreement with the crew, within 21 days from the date of expiration thereof (14th December, 1908), contrary to section 45, sub-section 1. of the Shipping and Seamen’s Act. 4908. The case was the first of the kind beard in Gisborne. Defendant pleaded guilty, and stated it was purely a case of oversight on his part, as ho did not think that the time expired so soon as it did. His Worship said that be was satisfied the breach, was an oversight. The maximum penalty was £5, but he would only impose a fine of 10s and 7s costs.
