FRIDAY, JULY 2.

Mr. TV. A'krovd was the presiding justice’ at the Magistrate’s Court yesterday morning. DRUNKENNESS. Three men. two of whom wero natives, pleaded guilty to charges of drunkenness and were fined 5s with costs 2s in default 24 hours’ imprisonment. One first' offender, who did not appear, was ordered to forfeit the amount of his bail. £l. ' Mr. Vincent Pyko then took his seat upon the Bench. ALLEGED TK~SPASS : Dennis Barry and Arthur i-e'ly were charged upon the information of Constable Doyie. of Te lvaraka, that on June 29th they did trespass on the TVaikohu station the property of Messrs. Hutchinson Brothers, and_ did refuse to leave when requested to do so ’ Mr. J. R. Kirk appeared for both defendants, who pleaded not guilty. The case against Dennis Barry was taken first. Constable Doyle gave evidence that the defendant was camping in a tent on Mr. Hutchinson’s property. Witness had written instructions from Mr. Hutchinson to prosecute all trespassers. He told Barry that if he did not leave he . would prosecute him. Defendant said he wanted a fortnight’s notice, and refused to leave. Witness then laid the present information. . Mr. Kirk said the case must be dis- ' missed because it had not been proved that Mr. Hutchinson owned the property and could give Constable Doyle authority to prosecute the defendant. The 1 ' Bench held that the ownership of the property had not been proved and the ease was dismissed. The case against Arthur Kelly was then taken. Mr. Kirk said the defendant had left the place after being warned, and he suggested that the police - should withdraw the case. Constable Doyle gave similar evidence, to that given jn the previous oase. Mr. Kirk raised the same point as-in the previous case, and the case was dismissed. >'
