PRICE OF A MEAT SAFE.
DISPUTE ABOUT £1
At the Magistrate’s Court yesterday morning Arthur Parnell, ironmonger, (Mr. Burnard) claimed £2 10s, value of a meat) safe, from Henry H. Mellor (Mr. Coleman). The sum of £1 10s was paid into Court. . _ ' Mr. Burnard said that the plaintiff was willing to concede an allowance of os, but not £1 iOs. Mr. Parnell quoted £2 10s for the meat safe, but when the account was pressed the defendant said the safe was only worth £1 10s. Athur Parnell said Mrs. Mellor called at his shop, in November last, and ordered a meat safe. Witness quoted the price at £2 lOs, and said he would make the article less in price if possible. ’The safe was made by Mr. F. E. Wilson and the price for the woodwork alone was £1 10s and the profit on the safe was 8s 6d. About three months after the defendant disputed the price and said the safe was only worth £1 10s. To Mr. Coleman: When defendant called at the shop he produced' a billhead filled in “account rendered," k‘2r 14s. Defendant’s son called at the shop and offered to .pay the £1 10s for the safe, but witness would not give a receipt in full. E. Harvey, book-keeper for plaintiff, said the first account sent out showed the price of the safe as £2 10s. Witness saw defendant and learned there was a dispute over the price.. ' Francis Wilson, cabinetmaker, said lie made the safe in question and charged 30s for the article without any ironwork. .. . The meat safe was then brought into Court. . _ _ ... Mr. Coleman said he would admit that the safe was ordered, and the price quoted at £2 10s. The defendant would not have disputed the price had he thought the article value for the money. Defendant was prepared to pay £2 10s for the safe which lie considered full value. . The defendant said that when he first got an account from plaintiff for the safe he called at the shop and told Parnell the article was not worth more than 30s. John Townley, cabinet maker, valued the safe in question as well paid for at 30s. He was prepared to make one for 255.
John Colley, builder and contractor, said lie would value the safe at 2zs 6cl. He was prepared to make a similar article for that price. Peter' Johansen said he made meat safes, and would make the artiole at 255.
After Mr. Burnard had addressed the Court hi! Worship said he was satisfied that the full value of. the safe had been paid into Court, and judgment would be for defendant,, with costs to he assessed.
