LAND BOARD.
SITTING IN GISBORNE. . A sitting of the Hawke’s Bay Land Board was held in Gisborne on Saturday. Present: Messrs. T. A. Brod- ■ rick (Commissioner of Crown Lands), AV. E. Akrcyd, G. Wright, It. Groom, and E. Lane. TRANSFER APPLICATIONS Miscellaneous license 88, block' VI, Buckley township. S. A. F. Morgan to M. F. Smith. —Held over until, next meeting. O.R.P. 319, section 1, block N, Ilangaroa. S.D. Lunn and Boland to 11. O. Boys (Mr. J. W. Nolan).—Transfer recommended. Applications) by Messrs. Nolan and Sheet for re-hearing of transfer F. A. Hansen to W. J. Bright and Richard Bright, O.R.P. 247, section 2, block 111, TJrutawa East, E.D. —Mr. W. J. Nolan appeared in support of the application and stated that an effort had been made to comply with the conditions.—The Ranger’s report on the matter being satisfactory it was decided to recommend the transfer. S.G.R. 84, run 71. Matakoa, S.D., J. W. Barclay and O. J. McLachlan to J. W. Barkley and Tiics. McLachlan .—Transfer recommended. O.R.P. 245, section 6. block IV., Urutawa East S.D., L. E., and A.' E. Campbell to L. E. and AV. 0. Campbell. —Transfer recommended. Considerable discussion followed the application, Mr. Lane falling foul of the Commissioner by disputing his ruling. A scene ensued and Mr. Lane was eventually ejected. An account of the occurrence occurs elsewhere in this issue. The difference of opinion was on the matter of the Board granting transfers right out or recommending transfers to the Minister. On the motion of Mr. AVright it was ! decided that the Commissioner take steps to obtain legal opinion on the matter as to the bearing of section 35 of the Lands Act Amendment Act, 1907, as upon section 83 of the Land Act of 1592.
O.R.P. 286, section 4, block IX., Motu 5.D.., C. F. Buscke to R. B. Baird.—Transfer recommended. A indication by Blair and Sainsbury for the Board to grant exemption from rent to R. B. Baird if previous transfer approved of. —The application was refused, the Board deciding to adhere to its previous resolution. Satisfactory explanation as to cause of non-residence were received in the following cases:—Teoti Mete, L.I.P. 261, section 10. block XllL.Nuhaka North S.D.; A. R. Mclntyre, L.I.P. 388, sections 51-53. block XV., Hangaroa, Tiniroto village ; Amy C. Spence. L.I.P. 357, section 48, Tiniroto village; Jas S. Cooper, sections 40-42, block GA 7 , Hangaroa 5.0., Tiniroto village; In the case of Rangi te Ngaio, L.I.P. 263, section 3. block IX, Nuhaka North S.D., the Ranger, in reply to the Commissioner said the native was not residing on the property at ail. —It was decided to give the native three months’ notice in which to take up his permanent residence on the land. The case of J. Humphries, R.L.S. 87, section 14, block A 7., Turanganui S.D., Te Aria settlement, was dealt with similarly. Mr. G. Stock waited on the Board on behalf of Mr. AV. J. Trafford. lessee of part of S.G.R. No. 20, Hangaroa district-, and asking that when then the adjoining run was resumed that Mr. Trafford be given right of access through that run.—The Commissioner said he would be visiting the run, and would see Mr. Trafford about the matter.
Mr. A. AlcPhail applied for grazing rights over sections 23a and 23b. block VI., AVairnata S.D. —Miscellaneous lease was granted at £2 per annum. The Te *Arai residents applied for section 15, block V., Turanganui S.D., Te Arai settlement, containing ono acre, for a public hall site.—lt was decided to recommend the sale of the section as requested at the upset price. Air. Al. J. Kirk, Te Arai, waited on the Board in reference to the forfeiture of section 9, block V, Turanganui S.D., Te Arai settlement, for non-compliance with residential conditions. He said a house had been put up, but unfortunate! v his wife, to whom he had transferred the section, was unab.e to fulfil the conditions. He asked if the section could he transferred hack to him.—The Commissioner said that it could not be done as the conditions had uot been complied with. —Air AVright thought it purely an evasion of the law. —It was decided that the lease be forfeited. Air. E. O. Stewart also waited on the Board regarding the forfeiture of section 13. block 5. Turanganui S.D., Te Arai settlement. He said ho was going to make* the whare he had taken bn to •the section into a residence.-—lt was decided to extend the time for three months. An explanation as to the cause for non-erection of permanent dwelling house on S.G.R. 65, run 72 Mangaporo S.D., was received from C. H. and J. Clark. They said they had all the material on the ground for a residence, and were only waiting for fine weather to build.—The explanation was considered satisfactory, and an extension of time for three months was granted. In connection with Mr. Wallis' application for section 4, block 1, Tokomnru S.D., 188 acres (national endowment). to be included in his S.G.R., the Ranger reported in favor of the application.—The Commissioner said the application could not be granted, as the section was a national endowment. The Board would have to nut the section up for public competition under renewable lease. —It was decided to adopt this course.
It was decided to again offer section 41a AVaikohu S.D. (Puha accretion), containing about ten acres, for public action at an upset price of £lO per acre. It was also decided to again offer the two Alotu sections that were previously put up, at the old upset price. The report from the ranger, assessing the value of improvements on section 4, block 9. Ngatapa, was recieved. The Te Arai Settlers’ Association applied for stock reserve on Te Arai settlement. —The Commissioner said he had received a petition from the Minister for Lands,, signed by 45 of the residents, desiring that the reserve
ho vested in the Cook County Council. —lt was decided that the matter be held over in the meantime. Mr A. S. AVachsmann,. purchaser of sections 78 and 79, block 8, Hangaroa S.D., submitted a satisfactory declaration as to improvements and a certificate of title was issued. The following leases were forfeited for non-compliance with conditions: A.- J. Little, section 45-47, block XA 7 ., Hangaroa S.D., Tiniroto village; YV. McCormack, section 32-35, Hangaroa village. It was decided to give H. B. Livingston, lessee of section 1, block XII., Patutahi S.D., Te Arai settlement, notice to reside on the property immediately. . The Board approved of the AVaikohu County .Council's scheme for expenditure of thirds. A discussion took place regarding transferees appearing before the Board and Mr Wright gave the following notice of motion: “That the Board t.ke into consideration the matter < f insist - in< r on the attendance of all transferees before the Board for examination in cases of transfer, the same as in ordinary applications for land.” The tender of Mr AA 7 . A. Tultyck, at -£8 per year, for the lease of Block 4, Buckley‘township, Telega Bay, containing 19 acres, was accepted. One other tender was received.
