_ - THURSDAY, OCTOBER- 28. (Before Mr. W. A. Barton, S.M.) DRUNKENNESS. A first offender who did not appeal forfeited the amount of his bail, £l, and a second offender, John Allan, was fined £1 and costs 2s, in default four days imprisonment. CIVIL CASES. Judgment was given for plaintiff in the following undefended cases: —W. J. R. Bruce (Mr. Salisbury) v. Rawhira £4 14s 6cl and costs £1 2s, Chas. Pitt (Mr. Finn) v Arthur Willis £2 2s 6d and costs 2s, J. C. Collins (Mr. Mann) v H. L. Jennings £9 6s and costs £ L 3s 6d, Collins and Young (Mr. Mann) v same £7 19s and costs £1 3s 6d, Mire Morera (Mr. Sainsbury) v J. F. Duffy £6 15s and costs £1 17s, and an order was made -for the possession of premises within 7 days; Bennett and Slierratt (Mr. Burke) v Parke Pittar £l4 2s 3d and costs 30s, Grundy and Sliennan Ltd v same £2O, and costs £2 6s, John Cochrane (Mr. Burnard) v G Callaghan £9 17s 6d and costs (by consent) £1 3s! 6d, Alfred P Coker v Albert Higliam £5 5s and costs Bs. Evidence was entered in the case or Anne Midgellv (Mr. Bright) v Taranaki Te Ua and judgment given for £22 17s 6d and costs £2. DEFENDED CASES. Nicholls arid Griffiths (Mr. Sainsbury) v Eliza Dickerson (Mr. Burnard) being for goods supplied. Evidence was given by claimant, who said the first intimation of the order was from a man whom lie afterwards knew as Sutherland, for gas rings to be delivered to the Victoria -Steam Laundry. Laurence Skeet, accountant for the claimants also gave evidence. The defence was that Sutherland had induced the defendant to leave her Victoria Laundry in Upper Gladstone Road and go in for larger, premises in Gladstone Road known as the Victoria Steam Laundry. Sutherland, took over the business and gave promissory notes for the same. Sutherland was engaged to marry the daughter of the defendant. In evidence the defendant said she sometimes received wages (30s per week) and signed for them in the wages-book. Sutherland liad cleared out without honoring the promissory notes and defendant had taken up her former business in Upper Gladstone Road. Andrew Davies, engineer, gave evidence for the defendant. His Worship said lie was satisfied that plaintiffs had given credit to Mrs. Dickerson and was therefore entitled to a judgment. Judgment was given for amount claimed £2 8s 9d and costs £1 7s. Hurulmru Nikora (Mr. Hei) v Hati Nepia (Mr. Burnard) claim oT £lO 14s for hire of a reaping machine. > Tire plaintiff deposed that the defendant got his machine and' .agreed to pay 8s 6d per acre for the privilege of cutting his (defendant’s) crop, and when witness asked for the money some time •after the defendant said he had no money but would pay out of the completion- of a carting contract. xlns had not been done. Several witnesses were called and after a lengthy hearing plaintiff was nonsuited. £2 13s costs being allowed to defendant. JUDGMENT SUMMONSES. Andrew Tuohy (Mr Burnard) v. Alfred Bush (Mr Hei) claim for rent. Mrs Bush presented a list as to the disposal of £9O insurance. An order was made for £7 10s in default 8 days’ imprisonment, hut ail order was allowed for defendant to pay 5s on 4th November aiid 5s monthly till the debt was paid off. Rees Bros. (Mr Bright) v. George Pevreal (Mr Burnard) an order was made for payment of £9 12s 6d, in default 10 days’ imprisonment, but defendant was allowed to> pay 12s 6d on 28th next month and 10s per month afterwards, when execution of order would be stayed.
