A PRISONER’S RIGHT,

rPr.n rnF.ss Association.! WELLINGTON, Dec. 3. The Appeal Court to-day gave judgment in the case of Rex v. McCann and Brown. The point was whether the judge could comment on the refusal of a prisoner to give' evidence in his own defence. Separate judgments were delivered by each of the five j udges wlio heard the case, Justices Williams, .Denniston, and Cooper holding that a judge could not comment,and Justices Edwards and Chapman dissenting. The conviction was therefore quashed by a majority. The Court- then adjourned till February 1.
