SUPPLYING A QUOTATION.
A FIRM’S EXPENSES
Evans, Neild and Co. (Mr T. A. Coleman) claimed £1 9s from Francis Overton (Mr Kirk), at the Magistrate’s Court yesterday morning before Capt. Chrisp and Mr A. H. Wallis, J.’s P. The claim was for cable charges in* curred in getting a quotation for timber from Sydney for the defendant. John Evans, timber merchant, gave evidence that in accordance with an arrangement made liis firm cabled for the quotation. The reply, stating the price of hard wood, was submitted to the defendant, but no quotation made. Defendant was specifically told that he would have to pay the cost of the cable. G. L. Evans gave corroborative evidence. ; Francis Overton, shipwright, said that he applied for a quotation for kauri pine and hard wood. There was no mention made about witness paying for the cable! The Bench decided that the probabilities were that the plaintiffs had made the stipulation that the cable was to be paid for by defendant and accordingly gave judgment for the amount claimed with 5s costs.
