United Press Association—Copyright (Received Ftmruary 4, 10.15 p.m.) LONDON, Feb. 4. Du ring the reading of documents, Justice Bingham remarked that Lord Sackville repeatedly held the petitioner out as his legitimate son. Justice Bingham was satisfied of Pepita’s marriage with the dancer Oliva. Iu the course of further discussion it was shown that the late Lord Sackville had left a sworn declaration that he never married Pepita, adding that, if she passed as his wife, it was for her reputation; also that his adopted children, including the .petitioner, wer not legitimate. It transpired that the respondent married the petitioner’s sister. The petitioner wrote to her in 1890, “Father could not have done more for us. We are Iris illegitimate children. ’ ’ When in IS9I she had a daughter the petitioner in a letter to his father regretted that the child "was not a boy to inherit the estates. A dramatic incident of the day was that the petitioner handed Sir Edward Clarke a letter requesting him to ask for an. adjournment for the production of certain documents collated in Spain, adding, “Should Justice Bingham refuse, I wish you to retire from the case. I do not care to go on further with such an unfair trial.”
Sir Edward Clarke, considering that his client was not guided by his advice, withdrew with his junior, the petitioners’ solicitor, likewist.
Justice Bingham is to decide to-day whether the documents are essential.
