In the ‘Sackville barony case, the claimant informed Mr. Justice' Bingham. that since be bad not been allowed to fetch evidence from Spain to prove that Don Oliva was a bachelor, he must withdraw the petition, though it broke liis heart to do so.
Sir Robert Finlay, for the defence, replied on the whole ease. He produced a copy of the claimant’s mother’s marriage in 1851 with Oliva. The copy was a stamped certificate. It was stamped in 1854, and was found among the woman’s papers. He alleged that it accorded with the church register before the latter had been tampered with, about the year 1900. •Judgment was reserved.
