An interesting .point in connection '.vith medical testimony was mentioned by Mr Justice Cooper at Auckland. It touched the legal position of a medical man who examines.the mental condition of a patient suspected 1 of being of unsound mind. Counsel, in cross-examin-ing a. doctor upon this’ipomt, asked Imm if "lie had caused a patient to strip. The witness replied m the negative. ‘‘lt would not be a proper thing to do. would it?” asked the Judge. “.Not unless I suspected some physical injury,” replied the witness. “If a medical man called in. to examine the mental state of a person made him strip against' his will,” said the judge, “it seems to me that he -would render hini-s-e'lf liable to a -prosecution for assault.”
