AN INCOME TAX CASE.
THE DEPARTMENT BACKS DOWN
[Pun Press Association. 1 DUNEDIN ; March 30. In November last the Commissioner of Taxes sued J. L. Denniston, agent for certain non-resident traders, for income tax. The amount originally claimed was £9 3s lid, hut on Air. Denniston refusing to pay, the Commissioner re-assessed tile amount at £3O 9s 9cl, and sued for that amount. The Magistrate held that the defendant was not protected’ under the Act, and gave judgment for the Commissioner. The defendant- lodged an appeal to t-lie Supreme Court on a point- of law. After further consideration, however, the Crown has decided that the Magistrate’s decision cannot he supported, and has intimated that no effort will be made to collect- the tax.
