(Before Mr. W. A. Barton, S.M.) DEFAULT OASES: Judgment was given for plaintiffs by default in tlie following cases: —Cook County Council v.Chas. W. ’Ferris, jurir. £l4 6s lOd and costs £1 3s; Henry John Andrew (Mr Barnard) v. Henry Field, £1 12s and costs 7s; Kate Warburton (Mr Mann) v. Francis Reginald Simmonds. £lO Ss and l costs £1 10s 6d. JUDGMENT SUMMONSES. Henry IS. Houltham (Mr . Coleman) agreed to an order being made to pay George Henry Arrow (Mr Barnard) £1 3s 6d within a week. Clayton and Nisbett (Mr Blair) applied for an order against Te Whetu Rutone, under a judgment summons for £32 12s Sd. I'lie Magistrate, as the debtor did not appear, ordered! the amount to be paid forthwith# ini default 30 days’ imprisonment. Antonio Dean (Mr Barnard) applie# for an order against S. Vernon, nnfe.v a judgment summons for £l4 3s odjT after hearing the debtor’s statement#’ the Magistrate declined to make r.niorder. I jCaim for carting. /llbeireacr Hah good (Mr Barnard) ciaiwrcd £22 9s from Tlios. R. W.arren (Mr Coleman) for carting material. The plaintiff stated that he was a carrier residing at Patutahi, and lie did carting for the defendant, who now owed Jiini £22 9s. He was engaged through a Mr Leslie, and defendant was informed of the increase in the cost of carting from time to time. Leslie gave evidence as to engaging plaintiff, and lie informed defendant of the increase in the cost of carting. He only once objected, and witness did not promise' to get the carting done for £2 a- ton. Frederick and Albert Habgood, sons of the defendant also gave evidence. Idle defendant stated that lie had a conversation with Leslie regarding the carting and the price arranged was £2 per ton. Leslie never mentioned that the prices had been raised. He paid £3O about April to plaintiff, before they said the price was raised. He only got one account for Parting from plaintiff. There were three or four carters on the same' job, and he paid one carter £2 a ton in April or May, and lie was under the impression the same amount' would be charged by plaintiff. He produced a cheque which showed he paid that i amount to the carter. When questioned by Mr Bernard, die admitted this carter was not satisfied. He denied that plaintiff’s sons had told ; liim..' that the price of carting had been raised. The Magistrate gave judgment for plaintiff for the amount claimed, witlr £6 12s costs. The sum of £6 Is had been paid into Court. AN INJURED HORSE. Hoera Rangipui (Mr Coleman), claimed £7 from Henry Keely, for jniurics to a horse, the.property of plaintiff; The defendant did not appear. The plaintiff stated that the defendant took his horse without authority, and when lie returned''it. the animal had its shoulder cut, and would be useless for six months; in fact it would never be right again. The Magistrate gave judgment for the amount claimed with costs £1 10s 6d.
