DEAL IN POTATOES.
WERE THEY BLIGHTED? A CIVIL ACTION. At the Magistrate’s Court yesterday, before Mr. W. A. Barton, SAL, Walter Pilcher (Mr. Burnard) claimed £3 2s from Joseph Cox (Mr. Stock), the value of five hags of potatoes supplied. The defendant had paid £1 7s into Court. The plaintiff gave evidence as to supplying the potatoes, and defendant refusing to pay for them because he said there were a large number of small potatoes, and some were blighted. Defendant wanted to take back three bags, but he refused.
J. E. Charles, who saw the potatoes, said that some of them looked to be bad.
William Pilcher, a brother of the plaintiff, said he assisted to dig the potatoes and bag them.. About a quarter were small ones—not quite the size of an egg. They were not too small to use, and they were not blighted.
The defendant stated that he arranged with plaintiff to purchase potatoes. Pilcher went to him in the first instance and represented that he had a first-class line of xjotatoes, free from blight, and that there were no small potatoes in the line. Defendant offered plaintiff 7s or 7s 6d, hut plaintiff would not accept that. Finally an arrangement was come to, and he decided to purchase. He examined the potatoes later, and found good potatoes on the top, but as he got down he found the potatoes were much smaller, and he stopped selling them. Some of the potatoes were blighted.. He showed plaintiff the potatoes when he called for his cheque, and there were 25 to 30 per cent, unfit for sale. Witness refused co take the potatoes unless plaintiff picked the small ones out. He agreed to pay for the two bags he had used.
Joshua Lawrence, who examined the potatoes, said that about 25 per cent, were blighted. There were a number of small potatoes. Thos. Ellery said there was 25 per cent, of blighted potatoes, and from 10 to 15 per cent, were rotten.
Henry Currie also gave evidence. Tiie Magistrate gave judgment for plaintiff for the amount paid into Court, £1 7s.
