COURT OF APPEAL.
A NEW TRIAL ORDERED
[PEE PEESS ASSOCIATION.] WELLINGTON, April 10. In the .Appeal Court the case cf Rex v. Harvard, alias Shepherd, was heard, The prisoner was charged with stealing a sheep dog, and, on a second count, with receiving it, knowing it to have been dishonestly obtained. The jury found that there was not sufficient evidence to prove that accused stole, the dog, and on a second count that prisoner detained the dog, knowing it to have been stolen, /the Court held that the verdict was ambiguous and inconclusive, not showing when the guilty knowledge arose, and ordered a new trial upon the second count at the next Palmerston North sittings.
