ROYAL SCOTCH WINS H.B STAKES.

HASTINGS, May 13. The Hawke’s Bay Jockey Club’s autumn meeting was concluded to-day in fine weather. There was a fair attendance, but the going was heavy. The sum of £10,711 was put through the totalisator, as against £7809 for the second day of the last autumn meeting, making the total for the . two days £21,428, as. compared with £14.441 last year, an increase of £6987. The following are the results:— Ohiti Hack Handicap Hurdles, of 100 sovs, 1Z- miles.—Golden Water 1, Appin 2, Tina Toa 3. AH started. Castleside was left at the post. A splendid race was won by a head, with four lengths between second and third. Time, 2min 43sec.

Okawa Hack Handicap, of 100 sovs, 7 furlongs.—Erin 1, Solon. 2, Raupare 3. Scratched: Cork. Won by a nose, a length separating second arid third, with the others close up. Time, lmin 35sec.

HAAVKE’S BAY STAKES, of 4.00 sovs, 6J- furlongs.

From a good start Royal Scotch went to the front, followed by Formby and Bandiera. After going a furlong Formby took, up the running until the entrance to the straight, wlier© Royal Scotch again assumed command, arid Madam Madcap moved into second berth. A great race home resulted, Mi-. Watt’s colt winning by three-parts of a length, and two lengths separating second and third. Time, lmin 23 4-5 sec.

Burke Memorial Stakes, of 300 sovs, 11 miles.—G. Clarebutt’s Lady Men-sc-hikoff (W. Price) 1, Vice-Admiral 2, Woodhey 3. Scratched: Fort AVilliam. Won by a neck, after a great finish. Woodhey was two lengths away third. Time, 2min 11 3-ssec.

Scurry Hack Handicap, of 100 sovs, 5 for longs.—Perceler 1, Axis 2, Auroa 3. Scratched: Tua Tahi, Lady Edna. Won by two lengths. Time, lmin 4 3-5 sec.

Mangatarata Handicap Hurdle Race, of 120 sovs, If miles.—Reumac 1, Eiya 2. Hoanga also started, but fell. Eiya led fromi half a furlong to- a nuilie and a half, when Reumac spurted and Avon by six lengths. Time, 3min 28sec. Juvenile Handicap, of 120 sovs, 5 furlongs.—Rawgiatua, 1, Blue- Lake 2, Trieze 3. All started. Won by a length, with a neck dividing second and third. Time, lmin 4 3-ssec.

TOLOGA BAY CLUB’S APPEAL UPHELD. WELLINGTON, Alay 13. The following is the judgment of the Racing Appeal Committee, in the appeal by the Tologa Bay Jockey Club against the decision of the HaAvke’s Bay Metropolitan Committee, in upholding the appeal lodged by Air. R. Reynolds, OAvner of the horse Fashion Plate, as the said horse was not trained by an unlicensed trainer, the material facts are as folio aa’s : Thomas Atkins, avlio had at one time been a licensed jockey, Avas under engagement to three oAvners to look after their. 'horses Avliile being prepared' for the Tologa Bay -races. The horses were all stabled at the private stable of one of the OAvners and Atkins received payment from; them jointly, but did! not provide feed. One of the owners appears to have been constantly in communication Avith Atkins, and the other tAVo only occasionally. All 1 three claim to have instructed Atkins as to work given to the horses, and Atkins, that he Avas engaged as stableman and notas trainer. In each ease in the entry form, the OAvner is given as the trainer. At the Tologa Bay races one of these horses, “Fashion Plate,” came in first for the Ladies’ Bracelet, and another, “AAvanui” ran third, but its jockey neglected l to weigh in. and on an objection being lodged the steAvards disqualified Fashion Plate under Part 21, Rule 2 of the Rules of Racing, for having been trained by an unlicensed trainer. An appeal against this decision Avas Upheld by the Aietropolitan Committee, and the Tologa Bay Racing Club in turn lodged the appeal now before us, against the reversal of its judgment. “Having heard’ the parties and' considered all the circumstances vye are of the opinion that Thomas Atkins must be regarded as the trainer of the three horses under, his charge, and that therefore, his neglect to take out a trainer’s license, involves the disqualification of horses ' trained, by him. We consider that the right of an OAvner to train his oaa-u horses Avithout a license must be considered rigidly as applying to cases Avhere such training is personally supervised, and is conducted from stables in the -occupancy of such owner. In this we have the facts that: (a) Thomas Atkins Avas superintending the working and feeding of the horses for three independent owners; '(b) Two of the owners resided at a considerable distance from the stables; (c) Thomas Atkins had been a licensed jockey and! a worker in training stables. Hence AA'e cannot resist the conviction that liis professional experience Avas the main reason for the gathering together of the horses under his care. We are further confirmed in our opinion by the obvrious inutility of restrictions as to licenses trainers, if they can be evaded by any OAvner or combination of OAvners engaging any person to act as stableman at distant stables, with general instructions as to his methods. “We also regard part 21, rule 2 as a special Avarning to OAvners, trainers,, and others against employing, to manage their stables, any person who has ridden or trained for hire. Such person, should, under the rules, apply for a license.

“We therefore uphold the appeal of the Tologa Bay Jockey Club, and confirm the disqualification of the horse “Fashion Plate” for the Ladies’ Bracelet under Part XXVII of Rule 3. The owner of Prestonpcins is-now adjudged the winner, but.is. only'entitled to the prize money offered for the first horse, as the second prize was not part of the stake, but a separate donation from: the race fund.
