Dum'bltei ton. dairy factory proprietor, sued J- >. B. Mae Ewan and Co. for £34 16s 6d, 3 on- the ground that instructions to stop 1 the sale of a shipment of cheese per the Arawa had not been complied with. 'lt 1- appeared fronl the evidence that plainL tiff wired to defendants instructing them to stop the sale, but before bab- • , ling to Londoir they wrote to plaintiff •i asking for confirmation of instructions, ' the result-being that the shipment was sold before the cable reached Home. The Magistrate held that the plaintiff ' was entitled to recover, and assessed damages at 3d per cwt on! 199cwt> giv- ’ ing judgment for plaintiff for £2 with costs.
