A judgment clearly defining Avhen a land agent lias earned his commission Avas given by Mr McCarthy, S.M., aT Court this morning in the case of Gassidy (land agent), v. Masters, a cla m for" £25 commission on the sale ot a property. The Magistrate said that where an agent is instructed to sell a property at a, certain price, and the agent procures a purchaser at that price Avhom the vendor accepts, and a binding contract of sale is entered into between the -vendor and purchaser, A\ho sign a contract; then in the absence of special terms ol employment, or of misconduct or misrepresentation. on the part of the agent, lie latter is entitled to commission, even although the .purchaser afterwards refuses to complete. Judgment Avas for plaintiff for £25, and costs £4 Bs.
