A QUESTION OF IDENTITY. ACCUSED RECEIVES BENEFIT OF THE DOUBT. The hearing of the charge of playing “two-up” against John Palmer was continued at the Police Court yesterBefore the case was proceeded with Mr. Stock, who appeared for accused, said that Johnston, a witness, had been called by the Court. The. previous evening, however, so he was informed, the witness was taken to the police station, where Detective Mitchell endeavored to extract a statement trom him. W hen a „ wrtness t w as called by the Court it was not right for either side to interfere with the witness. The Magistrate said that it was very undesirable that the witness should have been' spo|cen to at all on the matRolf Johnson and Adolphus Hansen, wharf laborers, in the course of their evidence, said that they could not remember the accused playing ‘two-up on the wharf on December 26th. The Magistrate said that there was some doubt as to whether accused was the person the police saw playing twoup” with Johnston. If the evidence of the barman Har.vey was truo, lie coulci not have been there. The police said they were 15; yards away, and it was just possible 'they might have made a mistake as to accused’s identity, the case would be dismissed.
