THE FIRST NEW ZEALAND CASE

COLONIAL SUGAR COMPANY INVOLVED.

[PER PRESS ASSOCIATION.! WELLINGTON, July '.V. The first case under the New Zealand Commercial Trust Act, _ 1910, came before the Chief. Justice in the Supreme Court yesterday. An interlocutory motion tor the production and discovery of information was laid in February against tlie Colonial Sugar Refining Company, charging the company with breach of the Act in that it had given preferential terms to a group of merchants, and that a table of discounts was in existence under which only purchasers oi unusually large quantifies of sugar could obtain benefit. The Merchants’ Association of New Zealand was joined with the Colonial Sugar Company as defendants. There are over 50 members of the Association, hut as a test of the individual position of all these members the Crown has selected the following leading Wellington wholesalers, -Messrs. Levin and Co., V . M. Bannantyne and Co., Joseph Nathan and Co. for the prosecution. Sir John Findlay and Mr Astler appeared for the Crown, Messrs Skerrett and Treadwell for the Merchants’ Association, and Messrs Myers and Neave for Messrs Levin and Co. Two matters were before the Court yesterday—one a summons and the other a motion for production. They are being heard together. The case was adjourned till -Monday.
