DIVORCE COMMISSION’S REPORT

Tho Divorce Commission recommends a simplified procedure of the local hearing of cases where tho joint income of the married couple does not exceed' £3OO per annum; also for proceedings m forma pauperis; limitation of the powers of summary courts to grant separations except in case of imniediato necessities; applications for permanent separations to bo made to the High Court.

The Commission also recommends a simple process of placing the two sexes on equality as regards tho grounds of divorce which may be obtainable for adultery, desertion for three years, cruelty, incurable insanity after five years’ confinement, habitual drunkenness after three years, imprisonment under commuted 1 death sentences, the grounds, for nullity to be incipient insanity, epilepsy, certain communitiable diseases, pregnancy by another (all these if present and concealed at the time of marriage). Death is to be presumably after seven years total disappearance or if the Court is satisfied that there are reasonable grounds for so supposing it.

All matrimonial cases will be heard before a Judge alone. The. report also recommends the prohibition of the publication or reports till the cases are finished. 'Hie Judge is to he empowered to order the exclusion of any portion of a case from publication. The Commission majority consisfed of nine and the minority of three. The majority recommend to allowBritishers domiciled in England, Tint resident elsewhere in the Empire, in the event of their cases being tried at the place of residence, to have the decree registered in England, such decree to be operative here if made on grounds permitted by the English law.

Tlie minority’s report- favors equality of tho sexes, hut recommends that valid marriages shall continue indissoluble except for adultery.
