GISBORNE ASSAULT CASE.
DAVID HUGHES BEFORE AUCK-
LAND COURT.
(BT TELEGR APH —SPECIA.B COBEESPONDENT] AUCKLAND, Juno 11. At the Supreme Court to-day David Hughes pleaded l guilty to a charge of having committed assault causing actual bodily barm at Gisborne. When asked if -he had anything to say, he protested .against an imputation that lie was unduly addicted to card playing, and stated that he had looked for work in Gisborne. The Judge remarked that he had read over the depositions and the matter did not seem to.be so' grave as had appeared at first sight. One of the witnesses for the Crown had stated that prisoner had received provocation .and had probably thrown a music stool at a man in order to forestall the latter in throwing a chair. Prisoner had, however, pleaded guilty, and had been represented by counsel. His Honor was willing to take into consideration the fact that prisoner had already been two months virtually in prison, and would give him a chance to pay a fine. Prisoner would be fined £lO with £4 5s costs, the amount to ho paid in two monthly instalments of £7 2s 6d. The procedure was that Hughes was sentenced to three months’ imprisonment with hard labor, the order to he suspended if the payments indicated were made. Prisoner was obviouslv grateful for the chance given by him the Court, and he seemed to be in the mcod to take to heart His Honor’s advice as to the advisability of refraining from drink and card-playing.
