" SUNRAY” GIRLS WIN CASE.
SUED FOR DEATH OF FRIEND
Some remarkable statements were made during the hearing of a case in the Court of Session, Edinburgh, when Kathleen M'Enaney, executrix-nomin-ato of the late Ernest Leigh, Charing Cross Read, London, sued the Caledonian Railway Company for £ISOO damages for the death of Mr Leigh, who was knocked down and fatally injured in Glasgow by a van belonging to the company. Before his death Leigh, who" was manager of a professional dancing troupe, executed a deed in which he entitled pursuer to any damages the company should be made to pay. Pursuer, who gave her age as thirtytwo. said in thexwitness-box she was principal dancer of , “The Eight Sun Rays.” Leigh was known professionally as Ernest Wilson, and she sometimes lived with him during the eight years she know him. He made her an a Jowance of £2 10s a week and in addition provided clothes for her and her children, while lie also gave her costly presents, anfongst them severe! diamond rings. Sho was laid up with an injured knee when she heard of tne accident to Mr Wilson, and had t o .b? carried to the railway carriage arriving ill Glasgow a few hours after Mr "Wilson’s death. She then .earned that she had been appointed lus exeeu--triv. In-cross-examination pursuer admitted that she was not a manied whmau. After hearing the evidence ot Air. Georeie Dorman, proprietor of “The Eight Sun Rays,” who stated that Mr Vi Don was a married man living apart from his wife, it was intimated that no defence would he led. His Lordship, in awarding pursuer £3OO damages, said that the action was simply one which was on the same footing as an action brought by the deceased before his death, and ceiltinued by his executrix, and the sum awarded was equivalent to a jury’s verdict.
