BOROUGH COUNCIL.

The Borough Council met on Tuesday evening. Present: The Mayor Crs Townley, Dunlop, Lewis, Ponsford, Harding, Joyce, Whinray, Morgan. A BEQUEST. J. M. Arundel applied for permission to cut down a poplar tree in front of his shop, which had been disfigured by the late fire. Cr Joyce moved that the request be granted. Cr Morgan seconded. Cr Whinray moved as an amendment that permission be granted on condition that the tree was replaced by another. Cr Ponsford seconded. The proposition was carried. GLADSTONE BOAD CONTRACT. Messrs Stevenson and Wallace applied for their deposit money on the above contract. Cr Joyce moved that the sum left (£8 18s lOd) be refunded to the sureties. Cr Whinray thought it would be well to leave the matter until the whole conditions of the contract were reviewed, and the final payment asked for. Cr Dunlop did not think the Council should lose any money over the con-1 tract. Cr Lewis moved that the money be refunded with the exception or the difference between the two contracts. Cr Ponsford thought a resolution had been passed enforcing the penalty, and estreating the bonds. Cr Morgan was under the impression that the penalty had been enforced. Cr Ponsford thought the penalty should be put on Mr Boland for. the scandalous manner in which he carried out the work. Cr Townley moved as an amendment, that the money be retained until it was settled who it should be paid to, and the Town Clerk inquire into the charges against the money. Cr Lewis withdrew his motion and Cr Townley’s motion was carried. Cr Joyce moved that a committee be appointed to enquire into the matter, the committee to consist of Crs Townley, Ponsford, Joycs and the Mayor. —Carried.

KNOX’s CONTRACT. Mr Knox wrote asking the Council not to inflict a penalty on him for being behind time with his contract, as there had been a deal of bad weather, and Mr Barker would not allow him to cart the stone across the paddocks during wet weather. Cr Ponsford thought the penalty should be enforced, as he believed Knox had taken two other oontracts.at the same time, and had neglected this contract for the others. . ,

Or Whinray moved that the final payment be made. . , Or Lewis seconded.—Carried. / The following from Mr Boland was read I beg to request that if any final payment be made by your Council on tbs Gladstone Boad contract, it be retained to pay for tools, powder, fuse, etc., supplied by Messrs South, Boylan, and Parnell for the purpose of carrying on the same. These accounts were promised to be paid by the sureties at the time I signed over the contract for them to receive all money due and all becoming due, -Thi 1 has not been done, they having applied Mrtlu balance, £27 10s, which I request be not given to them, they having refused to pay the butcher after stopping 15s per week from the men out of their wages, but leave me to pay it. Hoping that my request will receive your favorable consideration. Cr Joyce thought the letter deserved consideration. The goods had been supplied to the contractor on good faith. The request was not compiled with. BOAD overseer’s REPORT. Gladstone Road contract.—This contract is completed. I told the contractor yesterday morning to break all the big stones before i* could be passed. This he promised to do. I thought it advisable to put the stone a little wider on account of the sides being so low, otherwise it would have reached as far as Peel street. 450} yards of stone have been delivered in Mr Knox’s contract, and 591 yards on the first block, making a total of 1041} now delivered on 18 chains 0! Gladstone Boad. The contractor is 21 days beyond the time specified for this work, at 10s per day. It is now for your Council to consider the penalty. I would recommend a final payment for this work, subject to it being passed by the Public 1 Works Committee. Footpaths: Five chains 1 of footpath in Carnarvon street from Aber 1 deen road to the bank of the Taruheru river, and 10 chains through the Recreation ground to Disraeli Street is completed. This work cost £ll Ils Od. Day labor £2 16s l|di •< per vouchers. The Report was adopted. PATMENTB. The following accounts were passed

When Mr Drummond’s account of £4 4s, for preparing speolfioatlons for the laying of watermains, ahd erection of the flrebell, came up for coasideration, ; > Mr Ponsford said he did not think the account should be paid. The Town Clerk was authorised to tell Mr Drummond to prepare specifications, and the cost was to be two guineas. Mr Drummond had already been paid two guineas, which was a fair charge, and he now wanted four more.

Or Morgan said if the amount wae fixed no more should be paid. Cr Whinray thought the remunera- , tion was left an open question- He thought it would be best to pay Mr Drummond, but in future it wofild be best to have a fixed scale of remuneration for such work. The Mayor said Mr Drummopd had based his fees on a per centage of the cost of the work. Cr Dunlop thought the charges were high, and he would vote against the payment. When a man charged a per centage he supervised the work. Two guineas should be paid, and no more. • 4 v Cr Whinray moved that the aoocwrti. be paid. Cr Joyce, seconded the motion, as Im did not see any way of getting out of paying the money. 1 The motion was carried by five votes I to fouf.

TAn account from G. Humphries of £44 16s for “ extras ”in connection with the water mains contract, wae ordered to be laid on the table. SUPPLY OT METAL. Cr Whinray thought the Council should take some steps to carry his resolution into effect by inviting tenders for the supply of metal. He thought if the Council called for tenders for 5000 yards the stone could be got very cheaply. The contract might be extended over a couple of years. If a contract for such a quantity were let it would be worth while for the contractor to lay a tramway to the quarry. Cr Morgan thought as they had £BOO to spend they might call for tenders for 1500 yards. It was resolved that the Public Works Committee should report to the Council as to the best means of obtaining a supply of metal.

TKJTDEBS FOB ADVERTISING. It was resolved to call for tenders fer advertising.

HAITI HOAD.

Cr Townley said that nothing had yet been done to this road. —It was resolved that the Road Overseer should have the road formed at a cost of not more than £l5.
