BOROUGH COUNCIL.

The Borough Council met on Tuesday evening. Present:—The Mayor, Crs Townley, Lewis. Lucas, Coleman, Taylor, Harding, Whinray, and Joyce. THE POUSD : A COMPLAINT. The following letter from Mr V. G. Day was read:— I have the honor to bring under your notice certain facts concerning the manner in which the Gisborne Pound is conducted. Yesterday the 6th instant certain cattle belonging to Mr Bees were impounded by the Borough Ranger, as the poundkeeper informed me, about eleven o’clock in the morning. The eattle were released by me about a quarter to four in the afternoon. The poundkeeper charged me the sum of one shilling per head driving fees, and the farther Sum of two shillings for pound fees and sustenance. As the cattle were not impounded till after 9 a.m. and were released before 4 J.m. no charge can be made for sustenance. also found on enquiry that section 11 of the Impounding Act 1884 had not been complied with by the Ranger, thus rendering the whole impounding illegal. The poundkeeper keeps no proper pound book, nor is the pound in my opinion a properly constituted one, inasmuch as there is no shelter shed in it. The sum paid by me in order to release the cattle impounded was £2 2.-. Part 2 of the first schedule to the said Act does not authorise a driving charge of one shilling per head per mile, but only one shilling for any number not exceeding 25 in number. I have the honor to request that you will cause the amount so paid by me to be refunded to me, k as I have no wish to have recourse to legal proceedings for its recovery. This letter is without prejudice to any claim for damages I may have to make in the event of my having to take the matter before the B.M. Cr Lucas did not think the Council should waste any time in discussing the matter. Mr Day could take whatever remedy he thought fit, but he considered the Council should not recognise any claim whatever, and would move to that effect. Cr Lewis seconded the proposition, which Was carried.

AN OBJECTION. R. W. Fisher wrote stating that ho had objected to the valuation on his sections, and that the Assessment Court had made a reduction of £5O. bnt, through some error, the property had been placed on the list without the reduction. The Chairman said the Council could not tamper with the assessment list, as it had been signed by the Judge, It was decided to reply accordingly, SOAD ovsrpef.r's befort. Gravel contract,—The gravelling for Grey and Derby streets is completed. 155 yards have been put on Derby street, and 266 yards on Grey street, making a total of 4'21 yards delivered, at a cost of £73. I would recommend a final payment for same. I have had fourteen trucks of gravel put into the depot for ordinary repairs. About 15 yards of this has been used for repairing crossing junction of Custom House street and Gladstone Road. Read’s Quay—l4s loads of beach shingle have been put on this road between the end of Gladstone Road and the wharf, spread to a width of about 12 fret in the centre of roadway. This cost £l5 18s. fixing gas engine, etc.—Mr Jones has finished hie contract for fixing gas engine, pumps, etc, in the engine shed ; everything has been done satisfactorily and left in a workman-like manner and is now in good working order. I would recommend a final payment for the same, subject to it being approved of by the P.W. Committee. Carting for the month £22 19a ; this includes shingle for Read's Quay and other streets, Day labor £4 17s 1 *,d as par vouchers.

MAKARAKA DOMAIN. Cr Luces said he had been asked to bring this matter before the Council owing to the disgraceful manner in whieh the Domain was being kept. A clause was inserted in the lease which Mr Bailey held to the effect that the Domain bad to be cleared of all briars, bnt this was not done, and the land was now covered with briars and other weeds. The Council had taken over the functions of the Makaraka Domain Board and they should therefore see that the land was kept in a proper manner. He thought that Mr Bailey should be written to informing him that he had not complied with the lease and drawing his attention to the clause. The Clerk said Mr Bailey was given in the lease three years to clear the ground, and that only half that time had expired. The Council was quite protected as they held a bond o! Mr Matthewson for £5O, and that gentleman would hare to tee the lease complied with. Cr Lucas said that if the land was properly looked after it would make a good fecreation ground. The matter then dropped. ROAD METAL. Cr Whinray would like to know what was the intention of the Council with reference to supplying atone for the Gladstone Road. He understood that the Council would have ho prospect of getting any more from the Harb or Board. He thought the County Council should be asked to oombine in getting good metal, and gome steps should be taken before the winter seta in to get a good supply. The County Council had been communicated with on the subject, but the matter seemed to Lave been left in abeyance, The'Clerk stated the County Council had written for further information, but through the Borotfgh being supplied with atone from the Harbor Board the matter was not Attended to. ’ - pr Coleman said that it it were proposed to bring a tramway from Barker's Quarry to town the County Council would pot derive gny benefit, and they could not therefore expect their co-operation, If however, the tramway was brought through Makaraka, the County Counncil might then consider the matter. Cr Harding said it was qnite clear that the County Council intended going on their own hook. He thought soma steps should be taken at once in tne matter, and a committee be appointed to draw up a report for next meeting,

The Qh»irni«n thought the County Council plan was to make Patntahi their depot, as it was the most central part for them. Cr Townley thought the County Council would not give any assistance as they were retrenching, and were even not patting single tn the roads. Their only course would be to see whether they could obtain any more metal from the Harbor Board, or to call tenders for the supply of mefal from Barker’s (Quarry. He was convinced that the latter way would be the beat—it was more likely to come out sncoeseful then if they wasted time l n meeting other public bodies. Cr Joyce said there was no use in asking the Ccunty Council’s assistance, as they were in favor of getting metal from Palutahi, and that would be too expensive for the Borough. The Council Would have to work on their own fysoutces. The only question was whether the Haiti or Barker's stoke was the best, Cr Whinray said he 4ould rather see the waiter stand over for a year than io get iuftnior stone. He thought it would be far

better to wait till a large contract could be let and thus get it at a cheaper rate. It was ultimately agreed to apply to the Harbor Board for a further supply of metal, about 1000 yards. NOTICE OF MOTION. Cr Joyce gave notice to move “ That the Council take into consideration the necessity of obtaining a sufficient supply of water for the use of the Borough by means of an artesian well.”
