In referring to some of the penal clause! in the Bankruptcy Act, at Napier, Justice Rich mond said that he had sat days hearing cases all for nothing, finding in the end that no punishment could be awarded. The fault was through the legislature adopting clauses which had been tried at Home and had signally failed. A coach and team of horses had been driven through them by English lawyers, and he did not know why Colonial legislators had adopted them at all.
