Release of Mr Ward.

At the B.M. Court on Thursday afternoon (before Messrs Bennett and Lucas, J.P.’s) an application was made by Mr Day for the release from custody of E. ff, Ward, who was awaiting farther developments in regard to a charge brought against him ot acting in a manner indicating uneopndness of mind. Mr Day said he had consulted ytith Mr Blevwright (solicitor tor the other side) and he believed there would be no objection, Dr Pollen testified that he had visited Mr Ward and the latter then appeared to have quite recovered from his previous state, and wae quite rational. His opinion wae that Mr Ward bad got into that unfortunate etate through a combination of circumstances ; he bad been suffering tram kidney disease, and had bean taking alcohol and iaudgnum, Dr Innea also felt satisfied that it would be safe to release Mr Ward ; the latter had been suffering from the effects ot a narcotic, and no doubt had aoted like a madman. Mr Siey wrigbt said that in fees of the medical evidence, which showed that the oauae was a temporary one, he would not be justified in wishing the person to remain in oustody, Mr Day argued that the Bench could give an order tor the defendant to ba brought before them, and all parties to the ease being prefent it could then be withdrawn. Mr Blevwright agreed that such was the proper course. 3 ergeant Bullen pointed out that six guineas c.ists (doctor’s fees) had been incurred in the ease, but tbe Bench said, having studied the Act, it appeared no power wae given td allow costs in such a case—otherwise they would be provided for. Mr pay said that was no doubt an omission in the Act. In reply to the Bench Mr Sievwright said' that Mrs Ward had been informed of the action taken, and Mr Day eaid that he understood that .Mr and Mrs Ward would go together when leaving Gieborne. Upon Mr Ward being brought before the Court permission was given toe the owe to be wlthdrawa.
