COUNTY COUNCIL.
A MBBTiNC of the County Council was held on Thursday afternoon. Present: Cr« Clark (Chairman), Wethered, Orr, Murphy, and Hepburn. , ’ . In reference to the ease against Mr Barker, Mr B. N. Jones, solicitor for the Council io the matter, wrote mentioning that the appeal Bgainst the dooision in fator ot the. Council
had been upheld on a technical point without the merits of the case being goue into. He enclosed the communication he bad received from Messrs Hesketh and Richmond, who had conducted the case in the Supreme Court, and who, in noting thn allowance of the appeal, disagreed with the decision, and coincided with the opinion given to the Council on tho other points. However, he (Mr Jones) wonld not advise further steps being taken, on account of the expense involved.—The Clerk stated that the
expense so far had been £l3.—The Chairman asked if the case could not be brought on again.—The Clerk said nothing could be done in the matter until the fall judgment was received from Auckland. Mr Seymour wrote asking the Council to repair the road near hia homestead at Whangara.—The Engineer estimated that it would coat fully £3O to do the work.-Cr moved that the work be done.—Seconded by Or Orr, and carried. The Patutahi Road Board wrote tUMng that Mr Oaloott, who occupies wetwo w’• Patutahi, complained that Mr Knox naa injured the road to hin section by blast ng the stone immediately adjoining the road. They asked that the Council should allow tne Engineer to inspect the road and see if Mr Knox had encroached on the roft ? originally laid off.—The Engineer earn 1 was all a road reserve; he presumed tne Board wished to know whether Knox encroached on the road which Oalcott complained of. He said the quarrv was neariy in the centre of the reserve but Knox had told him that he was not within two chains of the track of Oalcott’s.—»Decided to inform Board accordingly. The Waiknhu Road Board wrote euggeiting the expenditure of £4O, Mota thirds, on the cutting opposite Hntchinson’a, on the road leading to the Mota, provided the Council subsidize such expenditure with an equivalent amount, and a further expenditure of £3O where necessary between the said cutting and Poututu, nn the same termt —Thn Chairman said it was an offer that the Council should not mist. He moved that tenders be called for the work. —Agreed
The Wairoa County Chairman telegraphed that two slips had been reported between Tiniroto and Beings, and that Hospital patients there wanted to return to Tiniroto, but could not.—The Clerk said he had telegraphed to Mr Dette to dn the work. R. E. Stevens wrote, asking the Council to remove the sHpt on the Waimsta road and to AH up the doep ruts and make the road pansshle for dray traffic | the road was noW sufficiently dried up tn do the work —The Engineer said that Mr Gray had asked him to have the road filled in, and he had em* ployed two men to do the work. The Secretary of th* Cemetry Trustees wrote asking for a contribution of £lO towards the coat of maintaining the cemetry. — 4groed to pay the amount. The Council then agreed to oall tender.

The Engineer said that the contractor, for the K%iteratahi bridge a«ked for £do for extra tarring and painting, but he won d only allow them £3, «o that there wonld no doubt be another claim on the Council for the balance. The Chairman, in accordance with notice, moved that the Board dispose of tho Waihsn property, and that tenders. be called-—Cr Wethered seconded the motion, which was carried. Tn regard to the penalty inflicted on Mr Knox’s stone contract, it was decided on the motion of the Chairman that the penalty be reduced by six days,—Agreed - The communication from the Patutahi Road Board which was read at the last meeting, was then considered —Or Hepburn moved that the penalty enforced on Mr Knox—£24—be handed over to the BoardSeconded by the Chairman.—Harried. The letter from Mr McLeod (asking for a testimonial), which was also held over from last meeting, was read.—The Engineer expressed full satisfaction with the wav Mr McLaod had oarried tho dutle. out of Oounoil'a Overseas.—lt wa. decided to lend Mr MoLeod a letter oonveying an exprewion of the satisfaation given.
