TAND TRANSFERACT LANDS ALIENATED or contracted to be alienated from the Crown in fee prior to tho coming into oneration of •* Tho Land Transfer Act, 1870," may be brought under . the provisions of tho Act by application from the persons entitled thereto. All Lands alienated from the Crown after the coming into operation of "The Land Transfer Aot, 1870," are subject to, and must bo dealt with, in manner prescribed by the Act. The following aro examples f tho fee payablo for bringing tho land under the pro visions of the Land Transfer Act:— 1. When the Title consists of a Grant, dated on or subsequent to the ,28th December, 1841, none of the land included in which has been dealt with — Where tbe Certificate of title is directed to issue in the name of the A >plicant : Value of land £100 .0)11 2 Where tho Certificate of title is directed to issue in the name of the Purchasor: Value of land £100 4 1 10 0 Theso charges aro increased by 4s 2d (Assurance Fund) for every additional £100 in value. 2. When tho Applicant is the original Grantee, and the land has been dealt with'; or whero tho Applicant is not the original GranteeWhore the valuo of tho land is £100 £2 14 2 Whero tho valuo of tho land £200 3 3 4 Where the value of the land is £300 3 12 6 Where tho value of tho land is £400 4 18 Whero the value of land is above £400, tho foes increase at the rate of 4s 2d (Assurance Fund) for every additional £100 in valuo. These charges also represent the oost of Convoying Land. Inasmuch as applicants to bring land under tho Act can direct the Certificates of Title to issue in the names of any other persons. Credit for Fees is Given, When desired by the Applicant in all cases where the proprietor applies to have the land registered under the Act in his own name, and the fees may remain unpaid until land is dealt with. • ''Any person/therefore, who wishes to [ his land under the provisions of the Aot, order that. whenever he deals with it he be in a position to avail himself of facilities ali'orded by having a Registered Title, can do |so Without Any Present Cost, by allowing tlfe fees to remain unpaid until such dealing [takes place. He will then bo in a position \to Mortgage, Transfer, Lease, or otherwise deal with his land at a moment's notice. - Any Title, however lorfg and complex, may be investigated at a cost to the Applicant of only, Five Shillings; for if the Title iB reected all fees'arp returned, with the exceptior of that amount, ' '' ''' J CERTIFICATES OF TITLE ARE ABSOLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED B_ THE GOVERNMENT. On all Conveyances by Deed under the" old system, the ooat of registration in the Deeds Registry, over and above the Solicitor's oharge, is never less than Fifteen Shillings, frequently very much more ; while land which has been bought under the provisions of " The Land Transfer Act " can be transferred at a totalcost of Eleven Shillings where a whole section is conveyed ; and where only partis conveyed (and therefore a fresh Certificate of Title is necessitated), of Thirity.-ono Shillings, which is the highest sum allowed by the Act, no matter what the yalue or area of the land. Under tho Regulations in force on and after the Ist January, 187^ the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to Ten Shillings in all cases wbere the value of tho land is under Ten Pounds. The total cost of executing a mortgage or lease of land, registered under the Ace, is Twelve Shillings, no matter what the amount involved, A mortgage may bo transferred or dis- \ oharged, or a lease transferred or surrendered for Five Shillings. It secures the principal benefits and advantages sought to bo attained iv a I system of registration qf deeds. 2. {[.lt renders retrospective investigation of title unnecessary bb to all land re* gistered. 8, It simplifies the Titles' to Real Property for the futuro, 4. It makes purchasers of the foo and leases perfectly secure. 6. It simplifies, to the utmost possible extent, the forms of transfer and the modes of conveyance. 6. It increases the saleable valuo of land. 7- lt tends to lower the rate ol intorost on loans secured on lands. 1 8. It gives facilities for tho sale of largo estates in allotments. Frauds in the purchase and Bale of land are effectually prevented, beeaußO tho Certificate ol Title in the possession ol the "Vendor shows tho oxuet condition ol the estate, i.c,, if tho cBUto bo mort» gaged, encumbered, or leased.
