Upon tho caso being onlled on Mr Pitt, who opponrod for defendant, said that no action had boon takon rolativo to procuring tho ovidonoo of Arnott as tho amount in disputo was too smalji to war* rant tho expenditure. Ho (Mr Pitt) was, however, willing to tako his stand upon the law of tho case. Mr M'Loan who represented tho plaintiff said ho objoctod to Mr Pitt ndducing any nrgumont in support of dofondant's case, ns tho hearing wn» practically closed at the formor sitting, and could not now bo ro-oponod to admit tho -arguments of oounsol.
