R. Noilson, for an ac commodiition Hconso, I'or. promisos at Cement Town, Murray Crook. Mr Moss appeared to oppose tho application on behalf of E. O'Brien. Sergeant Noyillo intimated that the police alsooppoßcd tho application. Tho Hcnoh sold that at tho last sitting of tho Court tho Bonoh had rofused to renew Noilson's license. Mr Pitt said ho had a petition siguod by two hundred porsous urging tho nocossity of a liconaod house at Coraont Town. Jiis Worship said that tho Bonoh was quito agreed as to tho necessity for tho accommodation, tho only question was as to Neilson's fitness to hold a liconso. At tlio last sitting of tho Court two sorious complaints woro lodged against him. Ho was acqusod of drunkenness and im« morality, ifiiyidouco was takon on tho oharges, and tho Bonoh then ruled that thoy had boon pro7od. If a rehearing woro now askod for to show that tho ohargos woro fnlso and tho former verdict erronoous, It would bo granted, but mm loss it woro shown thaftho' chargos woro false, no licouso could bo granted to tho applioant. Mr Pitt said ho would tako tho rohoaring, and callod tho following evidence :— John Trcnnory—l hnvo boon acquainted with Murray Crock from tho oponing of Iho Geld, also know Ncilson, tho applicant in this onso, and his house, On two or throo ocoasions havo stoppod at his bouso bosidos having callod thoro frequently: It was fivo or six yoars ago that I stayed at Noilnon's placo. Siuoo then havo oallod at his placo frcquontly and nothing camo under my observation to cnll for complaint. I havo known O'Brien for several years, I cannot say anything about his character. By Mr Moss— l havo not boon in Noilson's houso moro than throo or four titnos during tho last sit months. Thomas Clnro—l havo been living at Murray Crook for six or seven yoars nnd know .Noilson jl havostoppod at his placo frequently and always got n good clean bed and civility. Havo always had vory good accommodation, Cross-examined— Never took a onrd in my hands in his houso but twice 5 hnd two gamos of forty-fivos in tho houso ; I may havo playod dioo in tho houso, but I don't recollect. Hayo soon Noilson. tho worso for drinlr, Havo not slept in tho houso for four or fivo months. Patrick M'Guiro— l know Ncilsou, as also his houso nt Oomont Town. Havo not boon at his houso for two or throo yoars. By tho Bonoh— During tho timo I oallod at his houso it was well oonduotod. I novor slept there. John Wilson— l know Noilson's acco. mmodation hcuso ; I hover slopped thoro. I saw plonty of bods and blankots thoro, If live seen peoplo taking thoir meals thoro. Havo novor boon in tho bodrooms. . Sergeant Neville— Tho last occasion of my visit to Noilson's houso I found two notioos posted on tho hotel, hut nobody thcro. After ooooying for somo timo Noilson oamo down with M'Allistor ; upon examination of tho houso I found it in muoh tho sarao condition as proviously reported by Constable Bonnett. C. B. Noilson— l am tho applioant in this case. When tho Sergeant oamo up I was up tho Crook. I was not nwaro that he was coming. The ovidenoo just given by Sorgoant Noyillo is untruthful. Never said anything about M'Allistor to tho Sorgeant. Havo never hnd any complaints from visitors to tho homo, Mr Moss said ho had not been pro--1 pared for tho rehaariug and thoroforo had no cvidenco to produce in rebuttal but having rogard to tho vaguo nature of (ho cvidenco tondorod, ho wai quite
content to loavo tho matter as it stood. This olosed tho caso. J. Murray— l nni tho applicant for a licenso for promises ,at Commit Town. Mr pilt objected to tho application on bohnlf of 0; B. Noilson. Tho Bench horo rotirod to consider tbo cvidonco tendered. TJpoQ tjio Bench resuming his Worship said that tho transfer from Beilby to Cophrane, as also that of M'Connon to [ M'Donncll would bo grantod. With rognrd to tho application of Oharlos It. Ncilson, no ouflloiont roason had boon shown to warrnnt tho Bonch in revoking thoii* formor dfioiaion, TI»o Bonch regretted boing forced lo this oourso bocauso the applicent appeared to havo jt ono timo had a hi«h character in tho district, but it appeared to havo boon injurod by bad company and associations, which tho Bench muoh roc;roU,e.i Under those oiroumsfanoos tho application would bo rofasod.
