Fox wont carofully into the facto of tho case, and gavo as his view that errors lay ou both aides, but that the provocation to tho judges j wan great, and some of tho lnngungo u«ed by Barton was not to bo tolerate! by any Court. On the other hund, he thought; judges would have acted more judiciously had they simply refused to heor Burton in Court until he hud apologised. 'Hie punishment; was a fearful one to a person in Burton's position, but still when tho Court fined Burton ho defied them, nod said ho would not pay a peony. Tho whole danger of interfering with powers and independence of tho Suproino Court was so great to the liberties of tho subject c, ho hoped the House would not interfere. Mftcimdrew warmly supported the Bill. Ho said neither kings nor judge* were Infallible, and their powers should bo limited by statute. . M'Fartane thought a judge should have power only to commit; for a Jew hour*, so that bail could bo found, and the offender tried by a jury. Tho Premier will resume debate. October d«.
