He admitted that lie had not included the plaintiff's debt in the schedule of liabilities. Plaintiff said be had spoken to defendant at the time of filing, and he said he fully intended to pay the debt, as be could not think of putting a debt for a family bible down in bis schedule. However, defendant hud since been earning over £4 per week for nine months, hut stili refused to pay: The case had been brought more to expose defendant's principle.

Shaw v Kelly— No return of sum* tnons< Case adjourned. Shields Bros. r. David, claim for £18 5s 7d, for'potatoes and turnips. Defendant had paid £6 19s into Court, and disputed the balancs on the ground that the goods had been supplied to his wife, for her sole use and benefit, and against his instructions. Evidence was taken at some length, and at the conclusion plaintiff was nonsuited. Mr Lynch for defendant. Gilcbrist v. Green, claim for £2 10s, for a meat-safe. Plaintiff said the safe was ordered by defendant's wife, and her reason for not paying for it on delivery was that if she drew her money out of the bank she would lose the interest. Defendant said the safe was left at his house without order. Had a good safe of his own in the house, and had not used the other. Judgment for the amount claimed and costs.
