X AND TRANSFER ACT LANDS ALIENATED or contracted tc be alienated from the Crown in fee prior to the coming into oneration cf "The Land Transfer Act, 1870," may bb brought under Ihe provisions of the Act by application from the persons- titled thereto. All Lands lienated from the Crown after the coming ate operation of " The Land Transfer A 1870," are -subject to, and must be dea with, in manner prescribed by the Act. The following are examples f the fee payable for bringing the land under the pro visions of the Lnnd Transfer Act: — 1. When the Title consists of a Grant, dated on or subsequent to the 28th December, 1841, none of the land included in which has been dealt with — Where the Certificate of title is directed to issue in the name of the A iplicant : Value of land £100 fit 11 2 Where the Certificate of title is directed to issue in the name of the Purchaser: Value of land £100 1 10 0 These charges are increased by 4s 2d (Assurance Fund) for every additional £ K)0 in value. 2. When the Applicant is the original Grantee, and* the land has been dealt with ; or where the Applicant is not the original Grantee — Where the value of the land is £100 ... £2 14 2 Where the value of the land £200 3 3 Where the value of the land is £30 3 12 6 Where the value of the land is £400 4 18 Where the value of land is above £400, the fees ncrease at the rate of 4s 2d (Assurance Fund) for every additional £100 in value. These charges also represent the cost of Conveying Land. lnasmucn as applicants to bring land under the Act can direct the Certificates of Title to issue in the names of any otlier persons. Credit for Fees is Given, When desired by the Ap_ licant in all cases where the proprietor applies to have the land registered under the Act in his own name, and the fe-?s may remain unp it until land is deait with. Any person, therefore, who wishes to bring his land under the provisions of the Act, in order that whenever he deals with it he may be in a position to avail himself of the facilities afforded by having a Registered Title, can do so Without Any Present Cost, by allowing the fees to remain unpaid until such dealing takes place, lie will then be in a position to Mortgage, Transfer, Lease, ol* otherwise deal with Jiis land at a moment's notice. Any Title, however long and complex, may be investigated- at a cost to tbe Applicant of only Five Shillings ; for if the Title is reected all fees are returned, with the exception of tha lamoiu't. CERTIFICATES OF TITLE ARE ABSOLUTELY INDEFEASIBLE. * ALL TITLES ARE GUARANTEED BY THE GUVERKMENT. On all Conveyances by Deed under the old system, the cos>t of registration in the Deeds Registry, over and above tbe Solicitor's charge, is never less than Fifteen Shillings, frequently yery much more ; while land which has been bought under the provisions of " The Land Transfer Act " can be transferred at a total cost of Eleven Shillings where a whole section is conveyed ; and where only partis conveyed (and therefore a fresh Certificate of Title is j necessitated), of Thirity-one Shillings, which is the highest sum -allowed by the Act, no matter what the yalue or area of the land. Under the Regulations in force on and after the lst January, 187fc, the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to Ten Shillings in all caees where the vfiue of the land is under Ten Pounds. Th « total cost of executing a mortgage or lease of land, registered under the Act, is Twelve Shillings, no matter what the amount * involved. A mortgage may be transferred or discharged, or a lease trarsferred or surrendered lor Five Shillings. THESE OPERATIONS IN VOL YE NO DELAY.
