XAND TRANSFER ACT LANDS ALIENATED or contracted tc be alienated from lite Crown in fee prior to the coming into operation rf " The Land Transfer Act, 1870," may bo brought under the provisions of the Aet'by application from the persons, titled thereto. All Lirnds lienuted from the Crown after the coming ate operation of " The Land Transfer A 1570," are subject to, and must be dea with, in manner prescribed by the Act. The following are examples f the fee payable for bringing the land under the pro visions of the Lund Transfer Act: — 1. When the Title consists of a Grant, dated on or subsequent to the 28th December, 1841, none of the land included in which baa been dealt with— Where the Certificate of title is directed to issue in the name of the A vplicant : Value of land £100 ... to 11 2 Wliere the Certificate of title is directed to issue in the name of the Purchaser: Value of land £100 1 10 0 These charges are increased by 4s 2d (Assurance Fund) for every additional £100 in value. 2. When the Applicant is the original Grantee, and the land has been dealt with ; or where the Applicant is not the original Grantee — Where the value of the land is £'100 £ 2 14 2 Where the value of the land £200 3 3 Where the value of the land is £30 3 12 6 Where the value of the land is £400 4 18 W 7 here the value of land is above £400, the lees ncrease at the rate of 4s 2d (Assurance Fund) for every additional £100 in value. Theee charges also represent the cost o! Conveying Land. Inasmucn as applicants to bring land under the Act can direct the Certificates of Title to issue in the names of any other persona. Credit for Fees is Given, When desired by the Api licant in all cases where the proprietor applies to have the land registered under the Act in his own name, and the fe?s may remain unp»*< until laad is dealt with. Any person, therefore, who wishes to bring liis land under the provisions of the Act, in i order tha? whenever he deals with it he m;iy be in a position to avail himself of the facilities ailbrded by having a Registered Title, can do so Witkour Any Present Cost, by allowing the fees to remain unpaid until such dealing takes place. He will then be in a position to Mortgage, Transfer, Lease, or otherwise deal with his laud at a moment's notice. j Any Title, however long and complex, may be investigated at a cost to the Applicant of only Five Shillings ; for if the Title is reected all fees are returned, with the exception 01 tba iair,ou»t. CERTIFICATES OF TITLE ARE AUCOLUTELY INDEFEASIBLE. ALL IITLES ASE GUARANTEED BI THE GOVERNMENT. On all Conveyances by Deed under the old system, the cost of regfstration in tbe Deeds Registry, over and above the Solicitor's charge, is never less than Fifteen Shillings, frequently very much more ; while land which has been bought under the provisions of "The Land Transfer Act" can be transferred at a total cost of Eleven Shillings where a whole section IB conveyed; and where only partis conveyed (and thereiore a fresh Certificate of Title is l-ecessitated), of Thinty-one Shillings, which is the highest sum allowed by the Act, no matter what the value or area of the land. Under the Regulations in force on and after the Ist January, 187±, the charge for Certificates of Titles issued upon Memoranda ol Transfer is reduced to Ten Shillings in all cnees where the value of the land is under Ten Pounds. f ili t total cost of executing a mortgage or leaso of land, registered under the Act, is Twelve Shillings, no matter wUat the amount involved, A mortgage may be transferred or discharged, or a lease twvsferred or surrendered lorlJive Shillings. THESE OPERATIONS INVOLVE NO DELAY. Tbe following are some of the advances conierred by the Land Transfer system :-° 1. It secures the principal benefits aud ?d---vantages sought to ne attained in the system of registration ot deeds. 2. It renders retrospective investigation o 1 title unnecessary as to all "laud re gistered. 3. It simplifies the Titles to Real Property lor the future J 4.
