"The Counties' Act Suspension Bill " is the title of a measure introduced to Par* liament dunng the present session by the Hon. the Premier. The Bill has passed its second reading, and will probably become law before the close of the present session. The measure is intituled " JAji v Act to enable the Governor, on a petition of the majority of the electors of onv Coun'y to declare that • The ::: &mrtK£i K Act, 1876/ shall be suspended therein.' 4 and its provisions are as follows :— " Be it enacted by (he General Assembly bf New Zealand in Parliament ussembtedfr' and by the Authority of the same, as follows :-l. The Short Title of this Act is * The Counties Act Suspension Act, 1881.' 2, In this Act, if not inconsistent with the context,—- ' County ' mean? a county constituted under 'The Counties Act, 1876:' ' Council ' means the Council of a county so constituted : 'County electors' means persons qualified to vote at any election under ' The Counties Act. 1876:' Road Board' means the Council, Board, Trustees, or the person or body, as the case may be, having the management, control, or care of roads or highways under any Act of the General Assembly, or under any Act or Ordinance of any Provincial Legislature in force at the time of 4 he coming into operation of the Act i 'Outlying district ' means any part of a county which is not included in a road district. 3. It shall be lawful for the Governor, by Order in Council] to declare that 'The Counties Act, 1876/ shall cease to be in operation in any county whenever the following conditions have been' pom.pjied with, vz. : — (1.) That a petition, in the form op to tbe effect let forth in the First Schedule in this Act, is presented to the Governor, signed by a majority of the electors of the county, praying that^he aaid Act shall cease to be in force therein. {2.) That, after the petition has been so signed, and before presentation, it has been published, with the names attached thereto, at least three times in some newspaper circulating iff the county to which it relates. . . . (7.) If it it represented to the Governor that any of the signatures to any such petition or decjaration are false, or tjjat any of the persons signing were not en. titled so to sign, or that the statemeiits in such petition are untrue, or that the provisions of this Act in respoot tq such petition have not been complied with, the Governor may cause an inquiry to be made, and may adjourn the consideration Of such petition till the resujtjof such en.qal^ifelip^l!^^ fSjffiWrnjif may appoint one or more Commissioners to make such inquiry, who shall have all the powers in respect to the summoning qf witnesses and their examination upon oath, and to calling for the production of books and papers touching such inquiry, as m&y be exercised by or under any law for the time being in force by Jus* tires exercising summary jurisdiction. 4. Whenever ijje Governor is satisfied that the foregoing conditions have been complied with iie may issue an Order in Council declaring that ' Tbe Counties Act, 1876,' shall cease, on a day (o be named therein, to have, any operation within the county to which it relates. 5 On and after the day so named tbe said Act shall cease to be in force in the said county, except for the purpose of enabling the County Council to complete and carry out any contract, matter, or business then existing or commenced, and remaining unfinished. 6. All money and property belonging to the county on tbe day named in % Order in Council shall be disposed of and dealt with in such manner as the Governor . shall from time to time direct. 7. Any county in which the said Counties Act shall cease to be in operation by virtue of the provisions of (Ms Act ihall be and remain a county for- all other purposes. 8. All money which but for this Act would be payable to or receivable by any county brought under the provisions of this Act shall be received by such persons, aqd be paid to or divided amongst tbe several Road Boards and outlying districts are pomprised within the boundaries of (be said county in such manner as the Governor shall from time to time direct. In the ease of outlying districts tbe Governor shall also direct pn what works tbe money shall be expended,* and under whose superiiiteadence tbe works shall be carried on. 8. Jo any eonnty wherein •T?he Counties Act, 1870/ ha? ceased to have any operation under the provisions of this Act for a period of not less than twelve months, the Governor may; by ! rder in Council, revive the operatiop of the said Act in such county whenever the following conditions have heeq com* plied with, namely .— (1.) £ petition U presented to the Governor, prajipg that the operation of the said Act toay be revived in the county. Such petition shall be signed by a majority qf tbe persons entitled to rote at Road Board elections in the several road districts in tbe county, snd of the persons not to entitled who are for the time being en« titled to VQfp at an election of a member of the House of flepresenta tires upon a qualification in an outlying district within the cc unty. (2:) Subsections two,
