X AND TRANSFER ACT LANDS ALIENATED or contracted tc be alienated from the Crown in fee prior to the coming into ODeration of "The Land Transfer Act, 1870," may bfc brought under the provisions of the Act by application from the persons; titled thereto. All Lauda lienated from the Crown after the coming ate operation of "The Land Transfer A . 1870," are subject to, and mustbedea with, in manner prescribed by the Act. The following are examples f the fee payable for bringing the land under, the pro visions of the Land Transfer Act :— 1. When the Title consists of a Grant, dated on or subsequent to the 28th December, 1841, none of the land included in which has been dealt with— vVbere the Certificate of titl is directed to issue in the name of the A iplieant : Value of land £100 £. (j 11 2 Where the Certificate of title is directed to issue in the name of the Purchaser : Value of land £100 ! 10 0 These charges are increased by 4s 2d (Assurance Fund) for every additional £100 in value. 2. When the Applicant is the original Grantee, and the land has been dealt with j or where the Applicant ia not the original Grantee — Where the value of the land is £100 £2 14 2 Where the value of .the land £200 3 3 Where ibe value of the land is £30 3 12 6 Where the value of the land is £400 4 18 Where the value of land is above £400, the fees ncrease at the rate of 4s 2d (Assurance Fund) for every additional £JOO in value. Theae charges also represent the cost of Conveying Land. Inasmuch as applicants to bring land under the Act can direct the Certificates of Title to issue in the names of any other persons. Credit for Fees is Given, When desired by the Apj. licaut in all cases where the proprietor applies to hare the land registered under the Act in his own name, and the few may remain unpi't until land is dealt with. Any person, therefore, who wishes to bring his land under the proTisions of the Act, in order that whenever he deals with it he may be in a position to avail himself of the facilities afforded by having a Registered Title, can do so Witkout Any Present Cost, by allowing the fees to remain unpaid until such dealing takes place. He will then be in a position to Mortgage, Transfer, Lease, or otherwise deal with his land at a moment's notice. Any Title, however long and complex, may be investigated at a coßt to the Applicant of only Five Shillings j for if the Title is reected al] fees are returned, with the exception of tha t amount. OEKTIFICATES~OF TITLE ARE ABSOLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED B^ THE GOVERNMENT. On all Conveyances bj Deed under the old system, the co^ of registration in the Deeds Registry, over and übovc the Solicitor's charge, is never less than Fifteen Shillings, frequently ibtj much more ; while land which has been bought under the provisions of "The Land Transfer Act" can be transferred at a total cost of Eleven Shillings where a whole section is conveyed; aad where only partis conveyed (and therefore a fresh Certificate of Title is t'ecessitated), of Thirity-one Shillings, which is the highest sum allowed by the Act, no matter what the value or area of the land. Under the Regulations in force on and after the Ist January, 187 i, the charge for Certificates of Titles issued upon Memoranda of Transfer is reduced to 'i'en Shillings in all cases where the value of the land is under Ten Pounds. Th i total cost of executing a mortgage or lease of land, registered under the Act, is Twelve Shillings, no matter wUat the amount involved. A mortgage may be transferred or discharged, or a lease tßaraferred or surrendered lor Five Shillings. THESE OrERATIOftS INVOLVE NO DELAY. The following are some of the adrantiges conferred by the Land TransJer system :— 1. It secures the principal benefits aud advantages sought to* oe attained in the system of registration of deeds. 2. It renders retrospective investigation ol title unnecessary as to all hud re gistered. 3. It simplifies the Titles to Real Property for the future 4.
