TAND TRANSFER ACT LANDS ALIENATED or contracted tc be alienated from tlie Crown in fee prior to the coming into ooeration of "The Land Transfer Act, 1870," may be brought under the provisions of the Act by application from the persons- titled thereto. All Lauds lienated from the Crown after the coining ate operation of " The Land Transfer A . 1870," are subject to, and mustbedea with, in manner prescribed by the Act. The following are examples f the fee payable for bringing the land under the pro visions of the Land Transfer Act :— 1. When the Title consists of a Grant, dated on or subsequent to tbe 28th December, 1841, none of the land included in which has been dealt with — vThere the Certificate of titl is directed to issue in tne name of the A>plicant: Value of land £100 ... £q v 2 Where the Certificate of title is directed to issue in the name of the Purchaser: Value o* land , *"» :. * ... 1 10 0 lne«e charges are increased by 4s 2d (Assurance Fund) for every additional £100 in value. 2. When tbe Applicant is the original Grantee, and the land has been dealt with ; o* where the Applicant is not the original Grantee— Where tbe value of the land is £100 £2 14 2 Where the value of the land £200 3 3 Where the value of the land is —^9 , 3 12 6 Where the value of the land is £400 ; 4 1 8 Where tho value of land is above £400, the fees ncrease at the rate of4s2d (AeenrKce Fund) for every additional £JOO in Value. These charges also represent the cost of Conveying Land. Inasmuch as applicants to bring land under the Act can direct the Certificates of Title to issue in the names of any other persons. Credit for Fees is Given, When deßired by the Api licant in all cases where the proprietor applies to have the land registered under the Act in bis own name, and the fet « may remain unu I' 4 until land is dealt with. Anj person, therefore, who wishes to bring hwlanduuder the provisions of the Act, in order thai whenever he deals with it he may be in a position to avail himself of the Jacihtieß afforded by having a Registered Title, can do so Witkout Any Present Cost, by allowing the fees to remain unpaid until sucii dealing takes place. He will then be in a position to Mortgage, Transfer, Lease, or otherwise deal with his land at a niomeut's notice. Any Title, however long and complex, may be investigated at a cost to the Applicant of only Five Shillings; for if tbe Title is reectcd all fees are returned, with the exception ofthaiamouot. ■ ■ " • ' i CEBTIFICATES~OP TITLE ARE AUSQLUTELY INDEFEASIBLE. ALL TITLES ARE GUARANTEED BY TBE GOVERNMENT. On all Conveyances by Deed under the old wstem, the cost of registration in tbe Deed* Registry, over and above the Solicitor's charge, Jt never less than Fifteen Shillings, frequently very much more; while land which has been bought under the provisions of "The Land Ti-ansfer Act " can be transferred at a total cost of Eleven Shillings where a whole section ie conveyed j and where only part is conveyed (and therefore a fresh Certificate of Title is cecesaitated), of Thinty-one Shillings, which is the highest sum allowed by the Act, no matter what the yalue or area of the land. Under the Regulations in force on and after the Ist January, 187fc> the charge for Certificates o[ Titles issued upon Memoranda of lransfer is reduced to Ten Shillings in all cases where the value of the land is under 1 Ten Founds. A mortgage may be transferred or disobarged, or a lease tsawferred or surrendered for Jive Shillings. THESE OPERATIONS INVOLVE NO DELAY. The following are some of the advances conferred by the Land Transfer system :~ 1. It secures the principal benefits and advantages sought to oe attained in the system of registration of deeds. 2. It renders retrospective investigation of title UDneceeeary M to all laud re gistered. 3. It simplifies the Titles to Real Property ' for the future J 4. It makes purchasers of tbe fee and leases perfectly secure. t>. It simplifies, to the utm.mt possible c-.tLt, the forms of transfer and the modes of con veyance. 6. It increases the saleable value of land 7. It tends to lower the rate ot Merest on loans secured on lands. 8. It gives facilities for the <al? 01 lar* estates iv allotments. c P.
