DISTRICT COURT, REEFTON.

« * Friday, March 24th, 1882. (Before His Hondr Judge Broad.) The remaining business was disposed of to-day. POOLE AND OTHERS V. THE IMPERIAL MINING COMPANY. This was an action brought to recover the sum of £189 Is 3d for damages alleged to have been sustained through breach of contract on the part of defendants in stopping the plaintiffs from completing the sinking of a winze in defendants claim for which they had entered into a contract. Messrs. Perkins and Lynch appeared for the plaintiffs, Mr 'Jones for the company. According to the opening statement of Mr Lynch, the plaintiffs, or rather Poole, agreed to sink a winze 100 feet deep in the company's claim at £2 7s. per foot, commencing work in December last. They sank 45 feet when they were stopped from work by the Directors, and the amount due to them on 15 feet retained by the Company. This action was brought to recover that sum, together with damages alleged to be sustained through the termination of the contract. The defence was that according to one clause of the agreement entered into between the parties, it was stipulated that the work should be done to the satisfaction of the mining manager, and this was not to his satisfaction. The Company therefore claimed the right of terminating the contract, and also, according to another clause of the agreement, confiscating the amount due for work done. The hearing occupied a long time, and

his Honor reserved his decision, saying he would give his judgment either in Greymouth or Hokitika, at the ensuing courts.

An application from the Victory Company, set down for hearing, lapsed, in consequence of no one appearing to support it when called on. IN BANKRUPTCY. Robert Reagh applied for and obtained his order of final discharge. This was all the business and the court then adjourned.
