Civil Sittings.
I Dawson v. Mace. I Mr Jones for the plaintiff. This was an undefended action to recover the sum of £50, being £30 for board, &c., supj plied, and £20, on a dishonored cheque. Judgment was given for the amount, with costs £5 9s. Application uxder the muting companies' act, 1872. Mr Jones applied, on behalf of James M'Callutn, to rectify the share list of the Great Eastern Quartz Mining Company, Limited, under the following circumstauces. The company in qustion was formed by twelve shareholders originally, and subsequently was registered as consisting of 24,000 shares, each of the promoters holding 2000. Of these, a man named Anton Meyers was one, and as alleged, he subsequently sold a portion of his interest to the applicant for the sum of £50. It seemed, however, that he had previously sold his interest to one James Cochrane, but it was alleged that this sale was only of haif and not the whole. The question hinged on whether the sale to Cochrane was for the whole or part of the interest. Cochrane was admitted as a shareholder, but the company refused to recognise M'Callum's claim. A long argument , arose on the subject. Mr Jones ably supporting his client's claim, and bringing several authorities in support. Mr Lynch, however, objected to the jurisdiction of the Court to rectify as requested, and his Honor very unwillingly admitted the objection and refused the application on the ground of want of jurisdiction, but without costs. This was all the business, and the Court then adjourned.
